1. Overview

This website is operated by Plush Pickle. The terms “we”, “us” and “our” refer to Plush Pickle.

These Terms of Service apply when you visit our website, place an order, purchase a product or otherwise use our online services.

By using the website or placing an order, you agree to these Terms together with our Privacy Policy, Shipping Policy and Refund and Returns Policy.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot legally be excluded under the Australian Consumer Law.

2. Eligibility

You must be at least 18 years old to place an order, or have the permission and supervision of a parent or legal guardian.

You must provide complete, accurate and current information when placing an order. You are responsible for keeping any customer-account login details secure.

3. Products and Product Information

We take reasonable care to describe and display products accurately.

Product images may include styled or lifestyle photography. Colours can vary depending on lighting, screen settings and manufacturing batches. Minor variations in stitching, filling, texture, positioning and finish may occur between plush products.

Product measurements are approximate unless stated otherwise. Please review the written dimensions and selected variant before purchasing rather than relying only on perceived scale in a photograph.

These provisions do not affect your rights where a product is materially different from its description or does not meet a consumer guarantee.

We may change or discontinue products and may limit sales by quantity or location.

4. Orders

Submitting an order is an offer to purchase the selected products.

An order is accepted once payment has been successfully processed and we confirm that the order has been accepted for fulfilment.

We may reject or cancel an order where:

• A product is unavailable.

• Pricing or product information contains a genuine error.

• Payment cannot be authorised.

• We reasonably suspect fraud or unauthorised activity.

• We cannot deliver to the supplied address.

• The order breaches these Terms.

If we cancel an order after payment, we will refund the cancelled amount.

5. Direct Fulfilment

Some Plush Pickle products are stored and shipped directly by third-party suppliers or fulfilment partners, including suppliers located overseas.

Products in the same order may be sent from different locations and may arrive separately.

Although third parties assist with fulfilment, your purchase is from Plush Pickle. We remain responsible for providing remedies required under the Australian Consumer Law and will not require you to pursue an overseas supplier yourself.

6. Prices and Payment

Prices are displayed in Australian dollars unless otherwise stated.

The total payable amount, including any applicable shipping charge, will be displayed before you complete checkout.

You confirm that you are authorised to use the payment method submitted with your order.

Prices, promotions and discount codes may change without notice. A promotion is subject to any additional conditions displayed with it.

7. Shipping and Delivery

Processing and delivery information is provided in our Shipping Policy.

Delivery dates are estimates unless we expressly agree to a guaranteed date. Carrier delays, customs processing, weather events and other circumstances may affect delivery.

We will provide reasonable assistance where an order is delayed, lost or damaged. Nothing in this section limits rights that may arise under the Australian Consumer Law.

8. Order Changes and Cancellations

Orders may enter fulfilment shortly after being placed. Please contact us immediately if you need to request a correction or cancellation.

We cannot guarantee that an order can be changed or cancelled once processing has begun. Any cancellation that cannot be completed will be handled under our Refund and Returns Policy.

9. Refunds and Consumer Guarantees

Refunds, replacements and returns are governed by our Refund and Returns Policy and the Australian Consumer Law.

We do not provide returns, exchanges or refunds solely because a customer changes their mind. This does not affect remedies available for faulty, unsafe, damaged, incorrect or materially misdescribed products.

10. Product Use and Safety

You are responsible for following any age recommendations, care instructions and safety warnings supplied with a product.

Products intended for children should be used with appropriate adult supervision. Packaging, tags, ties and other removable materials should be kept away from young children.

Stop using a product and contact us if you believe it may be unsafe or defective.

You must not use our website:

• For an unlawful, fraudulent or malicious purpose.

• To transmit viruses, malware or harmful code.

• To interfere with the website’s security or operation.

• To scrape, copy or extract content without permission.

The Plush Pickle name, branding, website design and original text, graphics, photographs and other content are owned by or licensed to Plush Pickle.

You may use the website for personal shopping purposes. You must not reproduce, publish, modify, sell or commercially exploit our content without written permission.

Third-party trademarks and content remain the property of their respective owners.

13. Reviews and Submitted Content

If you submit a review, photograph, comment or other content, you confirm that:

• The content is truthful and based on your genuine experience.

• You own it or have permission to submit it.

• It does not violate another person’s rights.

• It is not unlawful, abusive or misleading.

You grant Plush Pickle a non-exclusive, worldwide, royalty-free licence to display and use submitted content for operating and promoting the store, unless otherwise agreed.

We may remove content that breaches these Terms.

14. Third-Party Services and Links

Our website is powered by Shopify and may use third-party payment, delivery, analytics or marketing services.

Links to external websites are provided for convenience. We are not responsible for external websites or services that we do not control.

Purchases made through Plush Pickle are transactions with Plush Pickle, not Shopify.

15. Errors and Availability

Website information may occasionally contain typographical errors, inaccurate stock information or incorrect pricing.

We may correct errors and update information. If an error affects an order that has already been placed, we will contact you and provide an appropriate option, which may include proceeding with corrected information or receiving a refund.

16. Liability

To the maximum extent permitted by law, Plush Pickle is not liable for losses that were not reasonably foreseeable or were caused by:

• Your misuse of a product.

• Your failure to follow product warnings or instructions.

• Incorrect information supplied by you.

• Unauthorised use of your account or payment method.

• Events outside our reasonable control.

Where liability cannot legally be excluded, these Terms do not exclude or restrict it.

Nothing in these Terms excludes liability or remedies arising under the Australian Consumer Law that cannot be excluded.

By placing an order, you acknowledge that necessary information may be shared with Shopify, payment providers, suppliers, fulfilment partners and carriers to process and deliver your purchase.

18. Changes to These Terms

We may update these Terms to reflect changes to our store, services or legal obligations.

The current version will be published on this page. Changes will apply from the stated effective date and will not retrospectively remove rights relating to an order already accepted.

19. Severability

If any part of these Terms is found to be unlawful or unenforceable, that part will be severed or limited to the minimum extent necessary. The remaining provisions will continue to apply.

20. Governing Law

These Terms are governed by the laws of New South Wales, Australia.

You and Plush Pickle submit to the courts of New South Wales and any courts entitled to hear appeals from them, without limiting any rights you may have under applicable consumer law.
